Hello and welcome. We are Spicy Guide. Here’s how we protect your data and respect your privacy. If, after reading what follows, you still have questions about anything in our privacy policy, just email us at privacy@spicy.cool. All the information we collect is related to providing the Spicy service and its features.

1. Our role in your privacy

If you download the Spicy Guide App or if you subscribe to our newsletter, or just visit our website, this policy applies to you.

2. When and how we collect data

Within the app, you can search, bookmark, create lists, build your personal guide, share stories, chat with your friends.

When using these features – or any others we roll out – you will inevitably share some information with us.

That is why we want to explain the way we use information you share with us in order to build a great product and give you a great experience with it. We also want to ensure you understand what information we collect, how we use it, whom we share it with, and the choices we give you to control, access, and update your information.

3. Types of data we collect

We collect the following type of information:

Information you choose to give us

Most of our services require you to set up a Spicy account, for which we need to collect a few important details about you: your username, email address and password. To make it easier for others to find you, we may also ask you to provide us with some additional information such as a profile picture, first and last name, a phone number.

Once you start using Spicy, we’ll collect all of the content you choose to post to the service (e.g. photos, comments, and other materials).

Finally, when you contact Spicy Support or communicate with us in any other way, we’ll collect whatever information you share with us.

Information we get when you use our services

To continuously improve the experience on Spicy, when you use our services, we collect information about which of those services you’ve used and how you’ve used them. Here are the types of information we collect:

When finding your friends. Because Spicy is all about communicating with friends, we have included in the app several ways to find your friends easily. To that end, in addition to the search bar, we may-with your consent-collect information from your device’s phonebook or from third-party social media sites you’ll authorize us to connect with. If you choose to invite someone to the Service through our “Invite friends” feature, you may select a person directly from the contacts list on your device and send a text or email. You understand and agree that you are responsible for any charges that apply to communications sent from your device.

User content. We collect the content you provide and any information attached to it, such as the messages exchanged on the platform, the photos and reviews you may post and the metadata provided with such content. Metadata is the technical data behind the user content.

Device information. We collect device-specific information (e.g. hardware model, operating system version, browser type) including unique device identifiers which are small data files or structures stored on or associated with your mobile device. A device identifier may provide us with information about how you use our services. We also collect device information that will help us diagnose and troubleshoot problems in the event of a crash or any other problem related to our services.

Cookies and similar technologies. When you use Spicy, we may use cookies and similar technologies such as web beacons, pixels, and local storage to collect information about your activity and therefore provide features to you. You always retain control over cookies, which can usually be removed or rejected through the settings on your browser or device. However, keep in mind that disabling cookies or other technologies could affect the accessibility and functionality of our services.

Log file information. Each time you visit a web page or app, log file information is automatically collected. That information includes your Internet Protocol (or IP) address, device information such as your web browser type and language, details about how you’ve used our services, pages viewed and other such information. We may also collect similar information from emails sent to our Users where we can track which emails are opened and which links are clicked by their recipients. That helps us improve our services over time.

4. How and why we use your data

Why do we need all the information we collect you may ask? To bring an amazing product to the Spicy community and services that we constantly improve. Thanks to that, we can do the following:

  • Develop, improve, maintain and ensure the security of our products and services
  • Help you efficiently access the services and remember your information so you can access the app faster
  • Verify your identity and prevent unauthorized or illegal activity
  • Monitor metrics and analyze trends and usage
  • Diagnose and fix technical problems
  • Personalize your experience (e.g. suggesting you friends or places you may want to follow or interact with)
  • Develop and test new products and features
  • Notify you of any changes to our service
  • Send you (with your consent) emails and messages about new features, products and services, and content

5. How we share your information

We may share your information in the following ways:

With the Spicy community. We may share your public information such as your username, name and profile picture. Depending on your privacy settings, we may share the usernames and names of people you follow or are followed by, any picture, story or comment you have consented to share.

With third parties. We may share your information with the following third parties:

  • With business partners that provide services and functionality for the app to function properly.
  • With third parties for legal reasons. We will comply with any valid legal request as long as we reasonably believe the law requires us to do so. We may also access, preserve and share any information we believe is necessary in order to: prevent and address fraud or other illegal activity, stop any violation to our Terms of Service, resolve security concerns, protect ourselves, you and others.
  • With third parties in the event of a change of control. In the event of a transaction such as a merger, acquisition, bankruptcy, dissolution or liquidation, your information (name, email address, user content and any other information collected through the service) may be among the items sold or transferred.

6. Your privacy choices and rights

Your choices

You can choose not to provide us with personal data

If you choose to do this, you can continue to use the website and browse its pages, but we will not be able to access the app without personal data.

You can turn off cookies in your browser by changing its settings

You can block cookies by activating a setting on your browser allowing you to refuse cookies. You can also delete cookies through your browser settings. However, keep in mind that disabling cookies or other technologies could affect the accessibility and functionality of our services.

You can change the authorizations you granted us through your device settings

If you have previously granted us access to better your experience in Spicy, you can always revoke them, whether it is accessing your contacts list, camera, photos or locations services. Keep in mind that this may affect the functionality of certain services.

You can ask us not to use your data for marketing

We will inform you (before collecting your data) if we intend to use your data for marketing and if third parties are involved. You can opt out from marketing by emailing us at privacy@spicy.cool.

Your rights

You can exercise your rights by sending us an email at privacy@spicy.cool.

You have the right to access information we hold about you

This includes the right to ask us supplementary information about:

  • The categories of data we’re processing
  • The purposes of data processing
  • The categories of third parties to whom the data may be disclosed
  • How long the data will be stored (or the criteria used to determine that period)
  • Your other rights regarding our use of your data

We will provide you with the information within one month of your request, unless doing so would adversely affect the rights and freedoms of other (e.g. another person’s confidentiality or intellectual property rights). We’ll tell you if we can’t meet your request for that reason.

You have the right to make us correct any inaccurate personal data about you

You can object to us using your data for profiling you or making automated decisions about you.

We may use your data to determine whether we should let you know information that might be relevant to you (for example, tailoring your experience within the app to you based on your behaviour). Otherwise, the only circumstances in which we will do this is to provide the Spicy service to you.

You have the right to port your data to another service

We will give you a copy of your data in CSV so that you can provide it to another service.

You have the right to be ‘forgotten’ by us

You can do this by asking us to erase any personal data we hold about you, if it is no longer necessary for us to hold the data for purposes of your use of Spicy. Just send us an email on privacy@spicy.cool asking us to do so.

7. How secure is the data we collect?

We have physical, electronic, and managerial procedures to safeguard and secure the information we collect.

Please remember:

  • You provide personal data at your own risk: unfortunately, no data transmission is guaranteed to be 100% secure
  • You are responsible of your username and password: keep them secret and safe!
  • If you believe your privacy has been breached, please contact us immediately on privacy@spicy.cool

8. Where do we store the data?

The personal data we collect is processed at our offices in Los Angeles, Sydney, Zug and Paris and in any data processing facilities operated by the third parties identified below.

By submitting your personal data, you agree to this transfer, storing or processing by us. If we transfer or store your information outside the EEA in this way, we will take steps to ensure that your privacy rights continue to be protected as outlined in this Privacy Policy.

9. How long do we store your data?

We will delete your personal data from our archives no later than 6 years from the last time you used Spicy.

10. Third parties who process your data

Tech businesses often use third parties to help them host their application, communicate with customers, power their emails etc. We partner with third parties who we believe are the best in their field at what they do.

When we do this, sometimes it is necessary for us to share your data with them in order to get these services to work well. Your data is shared only when strictly necessary and according to the safeguards and good practices detailed in this Privacy Policy.

11. Children’s privacy

Spicy does not knowingly collect any information from anyone under the age of 13 or knowingly allow such persons to register for the services. If we learn that we have collected personal information from a child under the age of 13 without parental consent, we will delete that information as quickly as possible. If you believe we might have any information from or about a child under 13, please write to privacy@spicy.cool.

12. Changes to our Privacy Policy

We may modify or update this privacy policy from time to time, so please review it periodically. Sometimes, we will let you know by revising the date at the top of the privacy policy section available on our website and mobile application. Other times, we may provide you with additional notice as appropriate under the circumstances. Your continued use of Spicy after any modification to this privacy policy will constitute your acceptance of such modification.
